Who has custody of your personal data?

By virtue of the provisions of the Federal Law for the Protection of Personal Data in the Possession of Private Parties and all other applicable provisions, Baufest LLC (hereinafter referred to as “BAUFEST” or the Responsible Party), with legal address at 777 Brickell Avenue, Suite 1210, Miami FL, 33131, expressly states and puts at your disposal the following information concerning your personal data.

What kind of personal data do we gather?

To develop and achieve the objectives stated in this Privacy Notice, BAUFEST gathers the following categories of personal data:

  1. Identification and contact data;
  2. Data on personal features;
  3. Data on social circumstances;
  4. commercial data; and
  5. economic, financial, or insurance data;

These personal data may be gathered by BAUFEST directly (via web or e-mail) o may be provided personally by yourself so that we can use them for the purposes herein indicated.

Do we gather sensitive personal data?

BAUFEST does not gather personal data considered sensitive by current legislation for any purpose foreseen in this notice.

What do we gather your data for?

Fundamental and necessary purposes:

  1. to inform interested parties interested about the services and products offered by BAUFEST;
  2. to inform interested parties of the cost of BAUFEST services and of the methods of payment;
  3. to carry out, supervise, and administer the contracting of services and the purchase of products offered by BAUFEST;
  4. to carry out, supervise, administer, and update personal data related to BAUFEST clients: individuals and legal representatives or contacts designated by legal persons;
  5. to announce changes and improvements in services and products offered by BAUFEST;
  6. to register and track services and products sold by BAUFEST;
  7. to bill for services provided and products sold, or to recover the value of the same, be it judicially or extra-judicially.
  8. to have a history record of clients and contacts.

Additional purposes:

  1. to send advertisement and promotional material for new services provided by BAUFEST or its commercial partners or affiliated, parent, or subsidiary companies.

If afterwards you wish to, you can revoke your consent for the processing of your personal data with respect to the additional purposes herein indicated by means of the mechanisms foreseen in this Privacy Notice and in accordance with the legislation in force.

Do we transfer your personal data to anyone?

BAUFEST may provide your personal data to other natural or legal persons within or outside the territory of Mexico for the purposes described below. The possible recipients of these transfers belong to the following categories:

  1. Parent, affiliated, o subsidiary companies of BAUFEST, for the purpose of forming a global data base of clients and contacts that will allow BAUFEST to create aggregated data bases.
  2. Parent, affiliated, or subsidiary companies of Baufest, for the centralized safeguarding of information for statistical purposes and a record of clients and contacts.
  3. Financial or banking institutions as indicated by the user for the billing and payment of services.

Consent for the transfer of your personal data

As stated in article 37 of the LFPD, the transfers of personal data referred to in the previous subsection do not require your consent.

Your personal data will not be transferred to any third party without our informing you of this procedure by means of an updated Privacy Notice or without first obtaining your consent.

If you do not wish your data to be transferred to specific addresses or parties, you may expressly inform BAUFEST of this when providing your personal data or at any other moment by way of your right to object, in accordance with the procedure established in the following section.

You have the right to access, rectify, cancel and object to the processing of your personal data. In all such legal cases, you will be able to exercise your rights of access, rectification, cancelation, and objection (ARCO rights) by means of those procedures which we have implemented and explain here.

The corresponding request must comply with the requisites established in the current legislation by means of a written request directed to our Department of Personal Data, and  which you can send to the e-mail account info@baufest.com and giving as the subject “ARCO Rights and/or Revocation of Consent.”

Your request must contain and annex the following:

  1. Your name and address, or another medium through which to convey the answer to your request;
  2. Those documents which serve to prove your identity or, as the case may be, the legal representation of that person who exercises the right in your name;

III. A clear and precise description of the personal data over which you wish to exercise any of  your ARCO rights, and

  1. Any other element or document which may facilitate the process of locating your personal data.

BAUFEST will inform you of its decision regarding your request within twenty working days. Should the request be found to be appropriate, it will become effective within fifteen working days as of the date of response by BAUFEST. If the information provided in your request is erroneous or insufficient, or the documents necessary to verify your identity or the corresponding legal representation have not been provided, BAUFEST will ask you, within five business days following receipt of the original request, to remedy these deficiencies. You will have ten business days to do so.  The corresponding request will be considered as not having been presented if you do not correct the error or deficiency within this time.

BAUFEST will provide the information or personal data requested on simple copies or with electronic documents in conventional formats (Word or PDF).

The use of electronic media to exercise your ARCO rights authorizes BAUFEST to answer your request by means of the same media, unless you clearly and expressly indicate any other another media.

It is important for BAUFEST to keep your personal data up to date as well as to ensure their veracity, validity, and accuracy. We would therefore be grateful if you informed us of any change that might be relevant during the time of your relationship with BAUFEST.

You can revoke your consent for the processing of your personal data. You will be able to revoke your consent to the processing or transfer of your personal data, without any retroactive effects, provided that such revocation does not imply the impossibility of meeting obligations arising from an already legal relation between BAUFEST and yourself.

Consequently, the revocation of your consent can result in BAUFEST ceasing to process your data for the purposes indicated in this notice, but it cannot ensure the cessation of the processing of your personal data during the time of your relationship with BAUFEST for contact use or as an active or inactive client.

In the event you revoke your consent, the procedure for doing so will be the same as that established in the immediately previous section for the exercise of ARCO rights.

Do you want to limit the use and dissemination of your personal data?

You can limit the use or release of your personal data by directing the corresponding request to our Department of Personal Data when you provide your information or even afterwards. To do this you can ask BAUFEST to limit the use of your personal data to determined sectors and geographic spaces.

The requisites to prove your identity, as well as the procedure for attending your request for limitations on the use or release of your personal data, will be the same as those defined for the exercise of your ARCO rights as stated in the present Privacy Notice.

Use of cookies

Who has custody of your personal data?

By virtue of the  provisions of the Federal Law for the  Protection of Personal Data in the Possession of Private Parties, or the “LFPD and all other applicable provisions, Baufest LLC (hereinafter referred to as “BAUFEST” or the Responsible Party), with legal address at 777 Brickell Avenue, Suite 1210, Miami FL, 33131, expressly states and makes available the following information on the processing of your personal data.

What personal data can we gather?

In order to develop and achieve the objectives described in this Privacy Notice, BAUFEST gathers the following types of personal data:

  1. identity and contact data;
  2. data on personal characteristics;
  3. academic and professional data;
  4. occupational details;

These data may be gathered by BAUFEST directly (via web or e-mail) or may be provided personally by yourself so that we can use them for the purposes herein indicated.

Do we gather sensitive personal data?

BAUFEST does not gather data considered sensitive by current legislation for any purpose foreseen in this notice. We ask you not to send us sensitive personal data, such as the state of your health or your affiliation with a union, or your religion, since these are not necessary for any selection process.

What do we gather data for?

Fundamental and necessary purposes

  1. to manage, verify, and administer information on candidates participating in a BAUFEST selection process or who send their resumés spontaneously to BAUFEST.
  2. to manage, verify, and administer resumés and professional information for the formation of a data base on candidates that may come to occupy a job position at BAUFEST.
  3. to develop profiles for the formation of data bases with added information for statistical and analytical tasks in BAJFEST.
  4. to inform you of any non-binding job opportunities that BAUFEST might offer.
  5. to convey the candidate´s data to BAUFEST parent companies, affiliates, or subsidiaries.
  6. to keep a record of candidates, not for longer than six months.

Do we transfer your personal data to anyone?

BAUFEST may transfer your personal data to other individuals or legal persons within or outside the territory of Mexico, for the purposes described below. The recipients of these transfers belong to the following categories:

  1. Parent companies, affiliates, or subsidiaries of BAUFEST so as to form a global data base on candidates that allows BAUFEST to generate aggregated data bases.
  2. Parent companies, affiliates or subsidiaries of BAUFEST, for the purpose of centralizing and safeguarding information for statistical objectives and to keep a record of candidates.
  3. National or international service providers so as to verify work, financial, and judicial histories.

Consent for the transfer of your personal data

As stipulated in article 37 of the LFPD, those transfers of personal data referred to in the section immediately preceding this do not require your consent.

Your personal data will not be transferred to a third party without BAUFEST first informing you by means of an updated Privacy Notice and obtaining your consent.

If you do not wish your data to be transferred to specific destinations or recipients, you may expressly notify BAUFEST of this when providing your personal data or at any other time by exercising your right to objection in accordance with the procedure set forth in the following section.

You have the right to access, rectify, cancel, and object to the processing of your personal data. In potential legal cases, you may exercise your rights to access, rectification, cancelation, and objection (ARCO rights) through the procedures we have implemented and explained herein.

The corresponding request must satisfy those requisites, established by the legislation in force, by means of a written document directed to our Department of Personal Data, which you will be able to send to this account: info@baufest.com, with the subject “ARCO Rights and/or Revocation of Consent.”

Your request must contain and annex the following:

  1. Your name and home address, or other means of informing you of the answer to your request.
  2. The documents that prove your identity or the legal representation of the person who exercises rights in your name.

III. The clear and precise description of the personal data over which you wish to exercise any   ARCO rights, and

  1. Any other information or document which might facilitate the process of locating your personal data.

BAUFEST will inform you within twenty business days of its decision with regard to your request. If the request is granted, it will become effective within fifteen days after the date of response by BAUFEST. If the information provided in your request is erroneous or insufficient, or the necessary documents to prove your identity or the corresponding legal representation, BAUFEST will ask you, within five business days following the receipt of your original request, to remedy these deficiencies. In such cases you will have ten business days to comply with this requirement. Failure to do so will result in your original request being considered as not presented.

BAUFEST will provide the information or personal data requested in the form of simple copies or electronic documents in conventional formats (Word or PDF).

The use of electronic media for the exercise of your ARCO rights authorizes BAUFEST to answer your request by means of the same media unless you clearly and expressly indicate that you wish to be answered through another media.

For BAUFEST, it is important to keep your personal data up to date as well as to ensure its veracity, validity, and accuracy. We would therefore be grateful to learn from you of any relevant change during your selection process or afterwards (up to six months following the close of the process).

You can revoke your consent for the processing of your personal data. As a candidate, you will be able to revoke your consent for the processing or transfer of your personal data, without retroactive effects, provided that this revocation does not preclude the fulfillment of obligations arising from a legal relation established between BAUFEST and yourself.

The withdrawal of your consent may result in BAUFEST discontinuing the processing of your data for the purposes indicated in this present Notice, but it cannot ensure the discontinuation of the processing of your personal data during a selection process in progress.

The procedure for the revocation of consent will be the same as that established in the previous section on the exercise of ARCO rights.

Do you wish to limit the use and release of your personal data?

As a job candidate, you can limit the use or release of your personal data by sending the corresponding request to our Department of Personal Data when you provide your information or even afterwards. For this purpose, you will be able to ask BAUFEST to limit the use of your personal data with regard to specific sectors or geographic spaces.

The requisites for proving your identity, like those for attending your request to limit the use or release of your personal data, will be the same as those defined for the exercise of ARCO rights and stated in the present Privacy Notice.
